Here's what usually goes wrong: a CTO signs with a nearshore outsourcing LatAm provider, gets a demo team that looks great on paper, and six months later is dealing with missed sprints, unexplained turnover, or a security gap nobody flagged during onboarding. What to actually ask:

  • What percentage of applicants pass your technical screen? (Reputable partners reject 90%+ of inbound candidates.)
  • Do you test system design, not just algorithmic coding? Senior engineering hires need to reason about architecture, not just pass LeetCode-style exercises.
  • Can you show anonymized technical assessment rubrics?
  • How do you validate claimed experience with specific stacks (Azure, Kubernetes, ML pipelines) versus resume keywords?

A partner that can't produce a structured technical evaluation process is outsourcing your risk back to you.

Step 2: Test Process Maturity Before You Sign

Talent quality gets partners in the door. Process maturity determines whether the engagement survives past month three.

During due diligence, request a walkthrough of:

Step 3: Scrutinize Security and Compliance Posture

This is the step most CTOs underweight, and it's the one that creates the most expensive problems later.

Minimum bar for any nearshore partner touching production systems or customer data:

  • SOC 2 Type II compliance, or a documented roadmap with dates
  • Clear data residency answers — where is code, credentials, and customer data actually stored during development?
  • Device management policy — are engineers working on company-issued, encrypted hardware with endpoint monitoring?
  • Background check process for engineers with access to production environments
  • Signed NDAs and IP assignment agreements that are enforceable under U.S. law, not just local jurisdiction

If you're building AI/ML systems that touch sensitive training data, add a fourth requirement: ask how the partner handles model artifacts and data governance across the development lifecycle. This is an area where generic staffing vendors consistently fall short, because it requires engineers who understand both infrastructure and the regulatory context of the data itself.

Step 4: Investigate Attrition and Bench Depth

Engineer turnover is the single biggest hidden cost in nearshore outsourcing, and most providers won't volunteer this number.

Ask directly:

  • What is your annual engineer attrition rate?
  • If an engineer leaves mid-project, what is your replacement SLA?
  • Do you maintain bench depth in the specific stack I need, or will you be recruiting after I sign?

Partners with dedicated, salaried engineering staff (versus a contractor marketplace model) typically report figures in the 8-12% range, closer to well-run U.S. engineering orgs. "Nearshore" gets marketed as a communication advantage, but it's only true if the partner staffs teams in-region with real overlap, not a blended model where work gets routed to other time zones under the hood.

Verify:

  • Where engineers physically work from (not just company headquarters)
  • Actual daily overlap hours with your core team
  • English proficiency level for the specific engineers, not the company average
  • Whether you get direct Slack/video access to engineers or only account managers

Step 6: Pressure-Test the Commercial Structure

Pricing models reveal a lot about how a partner thinks about the relationship.

  • Fixed monthly rate per engineer is easiest to budget and typically indicates a direct-employment model.
  • Hourly billing with margin stacking often signals a broker/subcontractor arrangement, which increases attrition risk and reduces accountability.
  • Contract flexibility — can you scale from 2 to 10 engineers without renegotiating from scratch? Can you convert to direct hire if the relationship evolves?

Ask for a sample contract before you're deep in the sales process. Vague IP assignment language or unclear termination terms are the two most common issues we see when reviewing agreements CTOs bring to us for comparison.

Red Flags Checklist

Before signing with any nearshore outsourcing LatAm partner, treat these as disqualifying if unresolved:

  • No documented technical vetting process
  • Refuses to disclose attrition rates
  • Can't name where engineers are physically located

  • Vague or non-negotiable IP assignment terms
